Бояркина О.А. Межгосударственные водные сделки

Аннотация: В данной статье автор рассматривает возможность формирования глобального рынка пресной воды. С этой целью проведен анализ межгосударственных водных сделок, совершенных на региональном уровне. Возрастающий дефицит пресной воды подталкивает государства, испытывающие проблемы с водообеспеченностью, осуществлять водные сделки со странами, обладающими достаточным потенциалом водных ресурсов. Рассматривается влияние географического фактора, способа транспортировки (технологический фактор) на ценообразование при водных сделках. Анализируются данные межгосударственных сделок как с изъятием воды, так и без изъятия (на трансграничных реках). В статье автор использует сравнительный анализ, метод анализа и синтеза, а также системный подход при рассмотрении региональных водных сделок. Автор приходит к выводу, что рынок пресной воды на региональном уровне уже сейчас активно функционирует и будет продолжать развиваться. Широкомасштабная же торговля водой едва ли получит дальнейшее развитие в ближайшем будущем, т. к. сегодня международное водное право не поощряет чистую продажу воды (т. е. продажу исключительно воды). Однако в долгосрочной перспективе с ростом спроса на воду имеющиеся в настоящее время зачатки регионального водного рынка могут трансформироваться в глобальный рынок пресной воды.

Abstract: This article explores the possibility for formation of global fresh water market. For this purpose an analysis of international water agreements executed on the regional level is being conducted. The growing deficit of fresh water forces countries that experience issues with water availability to make water deals with countries that possess sufficient potential of water resources. The work explores the influence of the geographical factor and means of transportation (technical factor) upon the price formation in water deals. The author concludes that the fresh water market on the regional level is already actively functioning and will continue to develop. However, a large scale trade of water would unlikely receive further development in the near future, since the current international water legislation does not promote pure sale of water (i.e. sale of just water). But in a long term prospects, with growing demand for water, the currently existing groundwork of regional water market could transform into global market of fresh water.
